Posted: 10 Dec 2013 05:58 AM PST Beginning to Bite The new provisions of the Maritime Labour Convention 2006 (MLC) – the seafarers "bill of rights' – have been beginning to bite since they came into effect in August this year. However, a recent case in the UK shows the need for close scrutiny of implementation of the convention. A port State control inspection of a Greek-owned, Marshall Islands-flagged vessel, "George" found that it was in a "filthy" condition with 12 deficiencies. While they may have seemingly been running low on Teepol they were incredibly in possession of a freshly minted MLC certification. The ship was served with a prohibition order because of rotten food, out-of-date provisions and a cockroach infestation of the galley, as well as the crew accommodation. The "George" is not the only problem vessel highlighted recently - Nautilus International has released details of a vessel detained in port, and which has been described as a "Mickey Mouse operation". Panamanian-registered bulk carrier "Donald Duckling", owned by TMT Shipping of Taiwan, was detained in the Port of Tyne after an inspection revealed a long list of serious deficiencies. Crew members are said to have had such poor food provisions onboard that they were forced to catch fish from the side of the vessel which they had to cook on deck using dunnage because galley equipment was out of order. The TMT vessel "Donald Duckling" is dogged by serious health and safety concerns, and reports indicate it could be set for an extended stay in the port. According to local reports, experts believe the vessel could be detained until at least Christmas. The 16-year-old Panama-registered cargo ship cannot leave until it has undergone urgent repairs, the Maritime and Coastguard Agency (MCA) said. The 18-strong crew, made up of Romanians and Filipinos, are being assisted by the local Mission to Seafarers, and they have been provided with care, communication and food. In a recent campaign the Mission to Seafarers has been raising funds for three hot square meals for seafarers, which is great, but what about the shipowners who allow this to happen? How can we ensure that they are brought to account? Surely in the 21st Century, and notwithstanding the MLC, we cannot allow seafarers to live like characters in a Dickensian novel. == fm shiptalk ====== __._,_.___

[pelaut] IMO adopts mandatory audit scheme Posted: 10 Dec 2013 05:58 AM PST IMO adopts mandatory audit schemeDec 06 2013 The at IMO Assembly, key resolutions and amendments to the mandatory audit scheme were adopted, paving the way for the scheme to come into effect by 2016, once amendments to mandatory instruments have entered into force. This mandatory audit scheme is seen as a key tool for assessing member states' performance in meeting their obligations and responsibilities as flag, port and coastal states under the relevant IMO treaties and then offering the necessary assistance, where required, for them to meet their obligations fully and effectively. The IMO Instruments Implementation Code (III Code), which provides a global standard to enable states to meet their obligations as flag, port and/or coastal States; the IMO Member State Audit Scheme framework and procedures; the 2013 non-exhaustive list of obligations under instruments relevant to the III Code and a resolution on transitional arrangements from the voluntary to the mandatory scheme, were adopted. Also adopted were amendments to the International Convention on Load Lines, 1966; the International Convention on Tonnage Measurement of Ships, 1969 and the Convention on the International Regulations for Preventing Collisions at Sea, 1972, as amended, to make the use of the III Code mandatory in auditing members to determine how they give full and complete effect to the provisions of those conventions to which they are party. Following this, in 2014, the IMO is expected to adopt similar draft amendments (which have already been approved by the MSC and the MEPC) to the International Convention for the Safety of Life at Sea, 1974, as amended; the Protocol of 1988 relating to the International Convention on Load Lines, 1966; the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, as amended; and Annexes I to VI to the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 relating thereto, and its 1997 Protocol, as amended. The adoption of the various amendments and their entry into force will form the basis for an institutionalised audit scheme, the IMO said. The meeting also adopted a number of resolutions submitted by the various IMO committees and by the Council's 27th Extraordinary Session. Those that could affect the tanker sector include: *Prevention and suppression of piracy, armed robbery against ships and illicit maritime activity in the Gulf of Guinea. *Guidelines on the preservation and collection of evidence following an allegation of a serious crime having taken place on board a ship or following a report of a missing person from a ship, and pastoral and medical care of persons affected. *Revised guidelines on the implementation of the International Safety Management (ISM) Code by Administrations. *Revised guidelines for a structure of an integrated system of contingency planning for shipboard emergencies. *Guidelines to assist investigators in the implementation of the Casualty Investigation Code; *Fair treatment of crew members in respect of shore leave and access to shore-side facilities; *Application of the International Convention for the Control and Management of Ships' Ballast Water and Sediments, 2004. * Implementation of the Convention on Facilitation of International Maritime Traffic (FAL). *Amendments to the survey guidelines under the Harmonised System of Survey and Certification (HSSC); *Guidelines for the designation of special areas under MARPOL. *Amendments to the International Convention on Load Lines, 1966 (1966 LL Convention), to shift the Winter Seasonal Zone off the southern tip of Africa further southward by 50 miles; *Recommendation on the use of adequately qualified deep-sea pilots in the North Sea, English Channel and Skagerrak; and in the Baltic Sea. *Recommendation on the use of national tonnage in applying international conventions. === fm tanker operator ======== __._,_.___

[pelaut] INTERTANKO welcomes BWM IMO resolution Posted: 10 Dec 2013 05:58 AM PST INTERTANKO welcomes BWM IMO resolutionDec 06 2013 INTERTANKO has welcomed the agreement reached this week by the IMO to revise the implementation schedule for the Ballast Water Management Convention and urged all governments to adhere to this new schedule. The IMO's Assembly adopted a resolution on Wednesday that pins the application dates of the convention to the entry into force date. This in effect makes all vessels constructed before the entry into force date 'existing' vessels and allows for the installation of a ballast water management system (BWMS) on those vessels at the first renewal survey following entry into force, INTERTANKO explained At present 38 countries representing 30.3% of the world's registered tonnage have ratified the convention. It will enter into force 12 months after the ratification by more than 35 countries representing more than 35% of the world's tonnage. The adoption of this resolution is a major step in making the implementation of the international convention workable once it comes into force, the organisation said. Last year, INTERTANKO led the submission of a paper to the IMO's MEPC, drawing attention to potential problems of implementing the requirements of the convention. Many of the implementation dates originally written in the convention had already passed and in particular, the period for installation would be extremely short, with several thousand ships per year needing to install BWMS. A proposal to review and revise the implementation schedule was included in the INTERTANKO-led paper and accepted by the countries represented at the MEPC meeting. The association's managing director, Katharina Stanzel, said, "The resolution provides the industry with a practical and clear implementation process and INTERTANKO urges all member states to adhere to this new schedule." The association's senior manager – environment, Tim Wilkins added, "We welcome this very positive development and look forward to making sure the type approval process for ballast water management systems provides shipowners with reliable equipment." = fm tanker operator ===== __._,_.___
